WAIVER AND RELEASE OF LIABILITY

In consideration for being allowed to use the facilities, services, and activities of Kentuckiana Indoor Golf, LLC, I, {name}, acknowledge, understand, and agree to the following:

Assumption of Risk

I understand that participation in indoor golf activities involves inherent risks including, but not limited to, personal injury, property damage, and potential contact with equipment. I accept full responsibility for any injury or harm that may result from my participation.

Release of Liability

I hereby release, waive, discharge, and hold harmless Kentuckiana Indoor Golf, LLC, its owners, managers, employees, affiliates, agents, contractors, successors, and assigns from any and all liability, claims, demands, or causes of action whatsoever arising out of or related to any loss, damage, or injury, including death, that may be sustained by me or to any property belonging to me, whether caused by the negligence of the company or otherwise, while participating in any activity or while in, on, or around the premises.

Rules and Safety Acknowledgment

I agree to follow all facility rules and understand that failure to do so may result in the revocation of my membership and/or immediate removal from the premises without refund. I agree to exercise common sense at all times and follow these specific rules:

• One person in the bay at a time.

• Only the person actively swinging may be in the bay.

• All others must remain behind the yellow line.

• No swinging of a golf club outside of the bay at any time.

• No food or drinks are to be placed on or near computers or electronics.

• No alcoholic beverages and/or smoking tobacco and/or vaping is allowed in the facility

• I may be held financially responsible for any damage to computers or equipment caused by negligence, including spills.

• I may be held financially responsible for any damage I cause to the facility including projectors, monitors, computers and turf

Discount Membership Agreement

If I utilize a discount code for a membership:

• I agree to remain an active member for at least one full calendar month.

• I agree to renew my membership at least once.

• If I fail to meet these terms, I agree that I will be charged the full day pass rate for each visit made under the discounted membership.

Responsibility for Damages

I understand that I may be personally liable for any damage to the facility, equipment, or other patrons caused by negligent or irresponsible behavior. This includes, but is not limited to, damage caused by improper use of clubs, hitting or striking equipment or people, or disregarding posted rules.

Medical Consent and Emergency Contact

In the event of an emergency, I consent for Kentuckiana Indoor Golf, LLC staff or representatives to contact {contact_name} at {contact_phone} (relation: {contact_relation}). I certify that I am physically fit and have no known health conditions that would prevent safe participation.

Acknowledgment and Agreement

I acknowledge that I have read this entire document, fully understand its terms, and agree to be bound by it. I understand that by signing this document, I may be waiving certain legal rights, including the right to sue.

By signing below, I affirm that all information is accurate and that I agree to the terms outlined in this waiver and membership agreement.

Membership Renewal Acknowledgement

I acknowledge I am purchasing a membership, I acknowledge and agree to the following:

1. Monthly Renewal
   My membership will automatically renew each month on the same calendar day as my original signup date, unless I cancel in accordance with the cancellation terms below.

2. How to Cancel
   I may cancel my membership at any time by providing notice through any of the following methods:

   • Text message

   • Email

   • Phone call

   • My membership portal

3. Cancellation Timing Requirement
   To avoid being charged for the next billing cycle, I must cancel at least one (1) day prior to my renewal date. If I cancel less than one (1) day before renewal, I understand my membership may renew for the next month and I will be responsible for that charge.
